DMCA Policy

1. Introduction

Rocky Stride LLC, the operator of the Local Event Marketplace ("LEM") application, respects the intellectual property rights of others and expects users of our platform to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), codified at 17 U.S.C. § 512, we have implemented procedures for receiving and responding to notices of alleged copyright infringement.

This policy outlines how copyright owners can report content they believe infringes their copyrights, how users can submit counter-notifications if they believe content was wrongly removed, and our policy regarding repeat infringers.

LEM is a user-generated content platform where users post listings for items they wish to sell. We do not control the content posted by users but will respond expeditiously to valid takedown requests in accordance with the DMCA.

2. Designated Agent

Rocky Stride LLC has designated the following agent to receive notifications of claimed copyright infringement:

This designation has been filed with the United States Copyright Office in accordance with 17 U.S.C. § 512(c)(2).

3. Filing a DMCA Takedown Notice

If you are a copyright owner, or an agent authorized to act on behalf of a copyright owner, and you believe that content available on LEM infringes your copyright, you may submit a written notification pursuant to the DMCA by providing our Designated Agent with the following information in writing (see 17 U.S.C. § 512(c)(3)):

Required Elements of a Valid Takedown Notice:

  1. Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works on the LEM platform are covered by a single notification, a representative list of such works.
  3. Identification of Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Please provide:
    • The URL(s) or specific location(s) of the infringing content within the LEM application
    • The username of the account that posted the allegedly infringing material
    • A description of the listing or content (including any listing ID numbers, if available)
    • Screenshots, if helpful to identify the content
  4. Contact Information: Information reasonably sufficient to permit us to contact you, including your name, address, telephone number, and email address.
  5. Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Statement Under Penalty of Perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

What Happens After You Submit a Notice:

Upon receipt of a valid DMCA takedown notice, we will:

  • Acknowledge receipt of your notice
  • Review the notice to confirm it meets the statutory requirements
  • Expeditiously remove or disable access to the allegedly infringing material
  • Notify the user who posted the content that it has been removed pursuant to a DMCA takedown notice
  • Provide the user with a copy of the takedown notice (with your contact information redacted, if you request)

4. Counter-Notification Procedures

If you are a LEM user and believe that content you posted was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to our Designated Agent.

Required Elements of a Valid Counter-Notification:

Pursuant to 17 U.S.C. § 512(g)(3), your counter-notification must include the following:

  1. Physical or Electronic Signature: Your physical or electronic signature.
  2. Identification of Removed Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled. Please include as much detail as possible, including:
    • Description of the removed content
    • The original URL or location within the LEM application
    • Any listing ID numbers associated with the content
  3. Statement Under Penalty of Perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you are located outside the United States, the Western District of Texas, where Rocky Stride LLC is located), and that you will accept service of process from the person who provided the original takedown notification or an agent of such person.
  5. Contact Information: Your name, address, telephone number, and email address.

You may also submit counter-notifications by mail to our Designated Agent at the address listed in Section 2.

What Happens After You Submit a Counter-Notification:

Upon receipt of a valid counter-notification, we will:

  • Promptly provide the original complaining party with a copy of the counter-notification
  • Inform the complaining party that we will restore the removed material or cease disabling access to it within 10 to 14 business days

If our Designated Agent does not receive notice from the original complaining party that they have filed an action seeking a court order to restrain you from engaging in the allegedly infringing activity, we will restore the material or cease disabling access to it within 10 to 14 business days after receipt of the counter-notification.

Please Note: If you submit a counter-notification, your contact information may be shared with the original complaining party as required by law.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Rocky Stride LLC has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers.

Our Policy:

  • First Violation: We will remove the infringing content and issue a warning to the user's account.
  • Second Violation: We will remove the infringing content, issue a final warning, and may temporarily suspend the user's ability to post new listings.
  • Third Violation: We will terminate the user's account and ban them from creating new accounts on LEM.

Additional Considerations:

We may also terminate a user's account after a single instance of infringement if, in our sole discretion, the infringement is particularly egregious, willful, or involves commercial-scale piracy.

We reserve the right to:

  • Terminate any account at any time for violations of our Terms of Service, including copyright infringement
  • Deny access to LEM to any user who has had an account terminated for repeat infringement
  • Consider the totality of circumstances when determining appropriate action, including the user's history, the nature of the infringement, and whether the user has demonstrated a pattern of infringing behavior

Warnings and strikes may be removed from a user's record at our discretion, particularly if a significant period of time has passed without additional violations.

6. Misrepresentation Warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents:

  1. That material or activity is infringing, OR
  2. That material or activity was removed or disabled by mistake or misidentification

may be subject to liability for damages, including costs and attorneys' fees.

Before filing a DMCA takedown notice, please ensure that:

  • You own the copyright in question or are authorized to act on behalf of the copyright owner
  • The use of the material is not authorized by the copyright owner, its agent, or the law
  • You have considered whether the use might qualify as "fair use" under 17 U.S.C. § 107

Filing false DMCA claims may result in:

  • Civil liability for damages, costs, and attorneys' fees incurred by the alleged infringer
  • Termination of your LEM account
  • Potential criminal penalties for perjury

We take the integrity of our DMCA process seriously and reserve the right to report fraudulent claims to appropriate authorities.

7. Limitations

This policy addresses only claims of copyright infringement under the DMCA. If you have concerns about other intellectual property issues, such as trademark infringement, trade secret misappropriation, or counterfeit goods, please contact us at support@rockystride.com and we will address your concerns through our general reporting procedures.

Additionally, please note that the DMCA applies specifically to copyright infringement. If you believe a listing violates our Terms of Service or Community Guidelines for reasons other than copyright infringement, please use our in-app reporting feature or contact us at support@rockystride.com.

8. Modifications to This Policy

We reserve the right to modify this DMCA Policy at any time. If we make material changes, we will notify users through the LEM application or by email. Your continued use of LEM after any modifications indicates your acceptance of the updated policy.
